Texas Whiskey Festival – Terms & Conditions

By purchasing a ticket or attending any Texas Whiskey Festival LLC event (in-person or virtual) (the “Event”), you acknowledge and agree to the following Terms and Conditions. These Terms constitute a revocable license to attend the Event and may be updated at any time.


1. License & Conduct

Texas Whiskey Festival LLC and its affiliates (“Texas Whiskey Festival”) grant you a revocable license to attend the Event. You agree to follow all Event instructions, policies, and guidelines at all times.

Your license may be revoked, without refund, if your conduct is deemed disorderly, unsafe, disruptive, in violation of these Terms, or in violation of any applicable laws or venue rules.


2. Security, Entry Conditions & Prohibited Items

Entry to the Event is subject to search at Texas Whiskey Festival’s discretion. You and your belongings may be searched prior to entry. By entering, you consent to such searches and waive any related claims.

Refusal to consent to a search may result in denial of entry without refund.

Prohibited items may include, without limitation:

  • outside alcohol or controlled substances
  • weapons
  • laser pointers
  • artificial noisemakers
  • strobe lights
  • glassware not provided by the Event
  • bundles, containers, or unsafe items

Texas Whiskey Festival reserves the right to confiscate prohibited items and deny entry to anyone possessing them.


3. Event Content & Informational Disclaimer

Any information shared during the Event is provided for general informational or educational purposes only, on an AS IS basis. Texas Whiskey Festival makes no representations or warranties regarding completeness, accuracy, usefulness, or timeliness.

Nothing at the Event should be construed as professional, legal, financial, tax, investment, or accounting advice. Opinions expressed by speakers or participants do not necessarily reflect those of Texas Whiskey Festival.


4. Photography, Video & Media Consent

By attending the Event, you grant Texas Whiskey Festival the irrevocable right to use your name, image, likeness, voice, movements, and statements in any live or recorded audio, video, photography, or other media captured before, during, or after the Event. These materials may be used in any medium for promotional, commercial, or editorial purposes without additional authorization or compensation.

Texas Whiskey Festival owns all copyrights in these materials.


5. Event Safety & Assumption of Risk

Attendance at an in-person event involves inherent risks, including but not limited to:

  • slips, trips, or falls
  • uneven ground, curbs, steps, or outdoor terrain
  • weather conditions
  • crowded spaces
  • alcohol consumption
  • food allergies or sensitivities

By attending, you voluntarily assume all risks associated with the Event. You are solely responsible for monitoring your own alcohol intake and consuming responsibly.

Texas Whiskey Festival strongly encourages the use of designated drivers, taxis, rideshares, or other safe transportation options.


6. Release of Liability

In consideration of being allowed to attend the Event, you release Texas Whiskey Festival LLC, its owners, officers, agents, contractors, vendors, partners, and volunteers (“Covered Parties”) from any liability, claims, demands, actions, or causes of action arising out of your attendance or participation, except in cases of gross negligence by the Covered Parties.

This release includes injuries or losses caused by:

  • your own actions
  • the actions of other attendees
  • conditions of the Event premises
  • weather or environmental factors
  • alcohol consumption

This release is binding upon your heirs, executors, representatives, successors, and assigns.


7. Indemnification

You agree to indemnify and hold harmless the Covered Parties from any claims, damages, liabilities, or expenses (including attorney’s fees) arising from:

  • your actions or omissions
  • violations of these Terms
  • negligence or misconduct
  • failure to comply with Event rules

8. Ticket Purchases, Refunds & Transfers

All ticket sales are final. Events are held rain or shine. No refunds will be provided except at the sole discretion of Texas Whiskey Festival in extraordinary circumstances.

If technical issues occur during purchase, you are responsible for confirming whether your order was completed.

Ticket Transfers

Tickets may be transferred to another attendee. The original purchaser is responsible for ensuring the new attendee:

  • meets all age requirements (21+)
  • complies with all Event rules
  • receives all necessary Event information

Texas Whiskey Festival assumes no responsibility for disputes arising from private ticket transfers.


9. Cancellation or Postponement by Event Organizer

Texas Whiskey Festival may postpone, reschedule, or cancel the Event due to circumstances beyond its control, including severe weather, venue issues, illness, emergencies, supply chain issues, labor disputes, or force majeure events.

If cancellation occurs, Texas Whiskey Festival will notify ticket holders with next steps. Remedies, if any, will be determined at Texas Whiskey Festival’s sole discretion.


10. Third-Party Providers

Texas Whiskey Festival may reference or offer services from independent third-party providers (“Providers”). Texas Whiskey Festival is not responsible for the actions, performance, or compliance of any Provider.

Any disputes regarding goods or services from Providers must be handled directly with the Provider.


11. Limitation of Liability

Except in cases of gross negligence by Texas Whiskey Festival, liability for any claim is limited to the amount paid for:

  • your ticket, or
  • services you received at the Event

You waive any right to consequential, incidental, special, punitive, or exemplary damages.


12. Age Requirement

Entry to the Event is restricted to individuals 21 years of age or older. A valid government-issued ID is required for entry.


13. Amendments to Terms

Texas Whiskey Festival may revise these Terms at any time by posting an updated version. Continued website use or Event attendance constitutes acceptance of any changes.


14. Governing Law & Arbitration

These Terms are governed by the laws of the State of Texas.

Any dispute arising from or relating to the Event will be resolved exclusively through binding arbitration under the Streamlined Arbitration Rules and Procedures of JAMS, held in Texas. Texas Whiskey Festival may seek equitable relief in any court of competent jurisdiction.
